What happens if I can’t provide the products or services offered in my federal contract?
First, look carefully at the official language in your contract, specifically Federal Acquisition Regulation FAR 52.249-14 – Excusable Delays, which includes delays caused by epidemics and quarantine restrictions.
Paragraph f of the regulation also states that “the Contractor shall notify the Contracting Officer in writing as soon as it is reasonably possible after the commencement of any excusable delay, setting forth the full particulars in connection therewith, shall remedy such occurrence with all reasonable dispatch, and shall promptly give written notice to the Contracting Officer of the cessation of such occurrence.”
Get in touch with your Contracting officer as soon as possible, and keep in frequent touch, so that you can work together to develop a mitigation plan.
The government still reserves the right to terminate the contract if there is a delay, but it will be for the government’s convenience rather than a default on your part.
